Proposal


This text serves as a preliminary outline for a strategic blueprint for an incoming Socialist Presidential administration. It outlines the precise legal, administrative, and constitutional maneuvers required to capture, consolidate, and defend state power in the immediate aftermath of an aborted right-wing coup.

We must proceed from the premise that an overt, right-wing Trumpist coup attempt during the 2028–2029 transition is highly probable. Should this coup materialize and be defeated by mass democratic resistance, the political horizon will become radically open. If the socialist movement aggressively seizes this specific moment of systemic rupture, it may find the structures more rotted in their foundations than it imagined. Conversely, if the coup does not occur, our operational window will be narrower—but no less real. The compounding criminality, institutional degradation, and constitutional overreach of the Trump administration, paired with the growing strategic strength of the organized socialist movement, will still provide the necessary leverage to execute a less bold version of the same structural maneuvers to consolidate working-class state power. 

Finally, it must be reiterated that this document is strictly an initial operational framework and an open proposal, not a comprehensive blueprint. Whereas the original right-wing Heritage Foundation document spanned nearly a thousand pages of granular administrative planning, this outline functions as a strategic catalyst. It is intended to be picked up, critiqued, and thoroughly elaborated by the immense wealth of brilliant comrades, organizers, and theorists who have dedicated their lives to solving the practical mechanics of working-class governance. It is a starting point, not the final word. 

1. Arrest and Remove the Traitors in Congress

The socialist executive must treat Congress not as a sacred deliberative body, but as an arena of structural maneuver. The current administration rejects the liberal axiom that a hostile congressional majority can paralyze a radical executive. Every consideration must proceed from the understanding that the Republican Party, spearheaded by President Trump, will not peacefully cede power to a Democratic nominee in 2028.

Upon the defeat of the 2028 coup, any elected Republican in Congress or across the states, as well as any conservative Democrat, who aided, abetted, or failed to act against the insurrection must be immediately barred from public office under Section 3 of the 14th Amendment. The Department of Justice, acting under the explicit direction of the President, must issue formal administrative declarations to enforce this disqualification. These coup-complicit legislators must be physically detained, arrested, or barred from the chambers. The total universe of qualified, present members will drop immediately upon the physical detention and arrest of these elements. The remaining loyalist, progressive, and socialist legislators, now constituting a functional absolute majority of the active quorum, must instantly vote to permanently expel the treasonous members, suspend regular rules, and pass emergency enabling acts.

Armed with this functional majority, one of the very first legislative acts of the emergency session must be the immediate admission of Washington, D.C. as the 51st state, permanently ending the racist and colonial status currently endured by the nation’s capital. 

2. Legislative and Administrative Warfare

Should the movement prove unable to fully disqualify the reactionary congressional delegation, paths remain open so long as the House is brought under subordination to radical demands. Should a hostile Senate refuse to approve or even hold confirmation hearings for cabinet secretaries and regulatory directors, the executive administration must deploy an unprecedented yet constitutional bypass.

A cooperative majority in the House of Representatives can pass a resolution to adjourn the first session of Congress for a period exceeding ten days. The hostile Senate will predictably refuse to concur. This non-concurrence triggers an explicit constitutional mechanism in Article II, Section 3, which grants the President unilateral authority to adjourn both houses of Congress to “such time as he thinks proper” in cases of disagreement. The President must immediately invoke this power to force a mandatory presidential recess, executing unilateral Recess Appointments for every single cabinet position, judicial appointment, and federal regulatory head, completely bypassing a hostile and undemocratic Senate.

If a totally oppositional Senate or Congress prevents this adjournment tactic, the administration must pivot directly to the Federal Vacancies Reform Act (5 U.S.C. § 3345). The White House must completely withhold formal nominations from the Senate, starving it of the opportunity to hold rejection votes. Instead, the President must utilize Section 3345(a)(3) to unilaterally direct senior civil servants who have served in their respective agencies for at least 90 days to assume the roles of "Acting Directors" and "Acting Secretaries" with full statutory authority. Concurrently, executive orders will rewrite internal agency successions, stripping formal unconfirmed positions of centralized decision-making powers and permanently delegating final administrative signing authority to ideologically reliable cadres operating under Acting status.

3. Subordinating the Judiciary to the Popular Will

The administration must treat the federal judiciary as an open battlefield rather than an independent arbiter. To break the power of a reactionary Supreme Court, the administration must immediately expand the bench by no less than ten seats to ensure an absolute majority to govern with a free hand without interference from reactionary judges.

If the court issues immediate injunctions to freeze emergency actions, the executive must instruct all federal agencies to openly ignore lower-court injunctions that lack explicit statutory backing. By stripping the judiciary of its administrative enforcement mechanism, its rulings are reduced to unenforceable paper. The newly consolidated Supreme Court majority must function as the administration's ultimate judicial solvent, operating with an explicit mandate to systematically and rapidly overrule, narrow, or dissolve all hostile constitutional and statutory precedents, completely immunizing material expropriations from future corporate legal challenges.

Nowhere else more than the Supreme Court has revealed its undemocratic and openly ideological character. The entry of sexual harassers, conservative ideologues, and Trump loyalists to the bench has shattered the illusion that the Supreme Court is a neutral, technocratic apparatus. It is a political institution and must be treated as one. Court-packing, in this context, is only a compromise in lieu of significant restriction or even abolition of the current form of the Supreme Court.

4. Purging and Inverting the Coercive Apparatus

A socialist administration that leaves the military, intelligence, and internal security organs of the capitalist state intact will be undermined. Under Article II, Section 2, the President possesses absolute, unreviewable authority over the assignment and positioning of all military personnel. The administration must immediately issue a universal command reassignment directive, summarily relieving every general officer, member of the Joint Chiefs of Staff, and combatant commander who has expressed hesitation in preventing the undemocratic coup either in 2028 or 2020.

Junior, ideologically reliable field-grade officers must be elevated directly into senior command slots via the fast-tracked promotion mechanisms of 10 U.S.C. § 624(c). The directors of the FBI, CIA, and NSA must be replaced via the Vacancies Act protocol with political cadres committed to American democracy and the will of the people. As many collaborators with or leaders of the previous regime must be prosecuted as possible, to the full extent allowed by our laws on treason and insurrection.

The Attorney General must operate as an open political instrument of the executive, establishing a permanent Anti-Fascist Prosecutorial Task Force. ‘Antifa’ must no longer be the bogeyman invoked by the far-right but the political policy of the State itself. This task force must adopt a posture of maximum aggression against the true engines of reactionary political power. It must hand down immediate indictments targeting GOP elected officials, collaborators, major GOP mega-donors, dark-money political action committees, corporate lobbying firms, and foreign interest groups like AIPAC that have systematically corrupted the legislative process. The objective is the total dismantling of the financial infrastructure that bankrolls the far-right.  Simultaneously, the President must exercise the absolute presidential pardon power to issue a total, unconditional blanket pardon for all political prisoners captured during the street struggles over the transition of power, as well as all political prisoners of the Trump era and previous eras.

Concurrently, the administration must address the foundational crisis of the domestic coercive state by initiating an aggressive federal restructuring of law enforcement to dismantle systemic racism. The DOJ will place all metropolitan police departments and county sheriffs' offices under immediate federal consent decrees, cut off all federal military-grade equipment pipelines to local police, and abolish protections like qualified immunity. Police forces will be systematically stripped of responsibilities better handled by unarmed, specialized social and mental health workers, breaking the cycle of state-sanctioned violence against Black and brown communities. 

Finally, the socialist executive must move to immediately dismantle the post-9/11 national security bureaucracy by abolishing the Department of Homeland Security (DHS). ICE and CBP must be fully dissolved, and their militarized border infrastructure dismantled. The administration must issue an immediate executive directive halting all deportations, closing all immigrant detention centers, and transferring remaining administrative immigration services to an entirely restructured civil agency focused on humanitarian integration rather than carceral terror. Border enforcement resources will be redirected to fund legal processing and community-based resettlement programs.

5. Regulatory and Financial Weapons

The administration must deploy the administrative state not to regulate capital, but to choke it, seize it, and subordinate it to the democratic will of the organized working class. A Socialist Executive must wield unquestioned authority to fire any agency head within the executive branch at will, thanks to the Supreme Court Decision Trump v Slaughter (2026). We are being told that this is, legally, the correct way to act as President. Balking here does not represent compromise, but stubborn refusal to see the facts before us. 

The National Labor Relations Board (NLRB)

The NLRB is a critical choke point for state power; it must be transformed from an arbiter of labor disputes into an offensive weapon of class warfare. Every member of the board must be removed and replaced with a socialist or pro-labor progressive. The newly weaponized NLRB must implement an immediate emergency regulatory overhaul radically in favor of organized labor.

Crucially, the board must reinterpret Section 7 of the National Labor Relations Act to declare that secondary boycotts, wildcat solidarity strikes, and political general strikes are fully protected concerted activities if executed against corporate economic sabotage. This grants workers complete legal immunity from above to physically seize production facilities, while non-compliant firms face immediate federal asset freezes.

Wall Street and the Federal Reserve

The Securities and Exchange Commission (SEC) and the Consumer Financial Protection Bureau (CFPB) must be completely replaced with progressives and socialists. The newly empowered agencies must immediately ban all short-selling, high-frequency algorithmic trading, and stock buybacks, while launching intrusive, predatory audits into the top 50 private hedge funds and commercial banks, freezing their liquid assets inside the Federal Reserve system to prevent capital flight.

The dangling carve-outs left to protect the Federal Reserve from executive accountability must be swept aside by a socialist-majority Supreme Court. The President must define any attempt to sabotage the welfare of the American people through interest rate hikes as a criminal dereliction of their public mandate, purging the central bank at will. The newly appointed socialist Board of Governors must instruct the Federal Reserve System to deploy its Open Market Operations under Section 14 to directly, indefinitely, and at zero percent interest purchase unlimited quantities of municipal and state bonds from socialist-led local governments. This completely bypasses the private bond market, providing bottomless liquidity from the federal state to fund public housing, free transit, and green industrialization. This is not a pipe dream. This is already happening–but the money is sent to the pockets of the uber-rich and to bail out mega-corporations. It is going to fund genocide abroad and State repression at home. This money–the economy in general–must be redirected to center people rather than profits.

The Federal Communications Commission (FCC)

The FCC must launch accelerated, summary reviews of the broadcasting licenses of all corporate-owned, right-wing media infrastructure. Their explicit promotion of the previous coup must be codified as a systematic violation of the statutory "Public Interest, Convenience, or Necessity" standard. The FCC must summarily revoke their spectrum licenses and seize their broadcast infrastructure.

The Federal Trade Commission (FTC)

For industries and monopolies that are not immediately slated for federal nationalization under the DPA (to be explained below), the FTC must be deployed to aggressively shatter corporate consolidation and break up corrupt and exploitative monopolies and oligopolies.

6. Material Expropriation and the Demolition of Empire

Housing and Healthcare De-Commodification

The President must declare a Permanent National Housing and Homelessness Emergency under the Stafford Act, unlocking immediate federal funding and sweeping aside local zoning and property laws. To immunize these maneuvers from valuation liabilities, the packed Supreme Court must fundamentally redefine the Fifth Amendment's Takings Clause. The Court must rule that during a declared national emergency, "just compensation" for vacant, bank-held residential properties and corporate-owned apartment complexes completely ignores speculative "fair market value." HUD and the federalized National Guard must then proceed with the physical occupation and transfer of these properties into de-commodified public housing trusts.

Simultaneously, the Secretary of Health and Human Services (HHS) must declare a National Public Health Crisis and exploit statutory loopholes to universally enroll the working-class population into Medicare, explicitly repudiating the "Major Questions Doctrine." Concurrently, HHS must seize the patents for all essential pharmaceuticals, enabling immediate mass-production of free generics.

Furthermore, the fully mobilized HHS will treat the defense of bodily autonomy as a core national security priority, universally guaranteeing and funding unrestricted access to abortion care and gender-affirming healthcare nationwide, completely shielded from state-level interference. 

Student Debt, Wealth Taxes, and Nationalization

The Secretary of Education must execute an immediate, unilateral administrative directive under the Higher Education Act of 1965 to completely cancel all outstanding federal student debt. The Treasury Department must fundamentally rewrite the administrative definitions of taxable events under Section 7805 of the Internal Revenue Code, defining unrealized capital gains on holdings exceeding $1 million dollars as immediately recognizable, taxable income, while expanding the IRS criminal enforcement division massively to freeze assets at the first sign of capital flight.

Invoke the Defense Production Act (DPA) to nationalize defense contractors, tech firms, and major corporations. These include, but are not limited to: Palantir, Lockheed Martin, SpaceX, the commercial airlines, the energy companies, the utility monopolies, the sports leagues, etc. The Supreme Court must overturn or re-interpret Youngstown Sheet & Tube Co. v. Sawyer (1952) to allow such nationalizations to occur without restraint. 

Yes, this does include AI firms and technology such as Anthropic and ChatGPT. The dearth of regulation and the direction of AI technology towards private profit is a social harm that must be rectified. In addition to freezing data center construction, it is necessary for the United States to democratically manage and direct a technology that threatens to completely reshape society and the American economy.

The Environmental Protection Agency (EPA) and Eco-Production

The climate crisis demands a dual approach that synthesizes aggressive ecosystem protection with massive industrial expansion. The EPA must implement stringent emergency carbon caps and punish corporate polluters. The administration must also utilize federal resources to build public eco-infrastructure—massively constructing state-owned solar, wind, and next-generation nuclear facilities, creating millions of unionized manufacturing jobs to power a fully decarbonized, high-energy society.

The Withdrawal of the American Empire

The execution of anti-imperialist foreign policy must follow a strict, rapid operational protocol:

Invoke the Foreign Assistance Act and the Arms Export Control Act to freeze all weapons transfers, logistics support, and intelligence sharing to all imperialist proxy states, right-wing regimes, and colonial occupations (especially Israel), halting defense contractor shipments at the ports via federal customs authorities.

Utilize absolute Commander-in-Chief authority to invoke the War Powers Resolution, issuing a universal directive for the immediate, unconditional extraction of all American military personnel from overseas installations and ordering the decommissioning of all ~800 overseas bases.

Declare a National Emergency regarding international financial extraction under IEEPA, unilaterally canceling and forgiving all bilateral debt owed by nations of the Global South directly to the United States Treasury, while using the absolute U.S. veto at the IMF and World Bank to block all neocolonial structural adjustment programs.

The United States must commit to a program of global peace and mutual development. The tariffs must be removed, and the American economy must be integrated with the world economy. Not only is this the only means to ensure that the United States maintains its edge in innovation and economic development, but it is also necessary to deepen interconnectivity and prevent the Trump administration’s long-term plan of decoupling the US from other countries to allow for more aggressive military intervention.

7. Fight the Undemocratic Constitution

The ultimate structural security of the socialist state requires transitioning from administrative consolidation to permanent constitutional inversion. The administration rejects the liberal view that the U.S. Constitution is a static, unalterable framework of governance.

By executing the state-level quorum-compression, statehood admission, and 14th Amendment disqualification maneuvers established in the preceding sections, the movement must break the restrictive architecture of the bourgeois state. The administration must plow through or bypass the restrictive frameworks of Article V and issue a call for a democratic Constituent Assembly. This assembly must draft an entirely new Socialist Constitution—permanently founding the state on guaranteed economic rights, socialized production, and genuine majoritarian democracy.

Of course, it is questionable to what degree a socialist Project 2029 will actually be fulfilled in practice. But it is necessary to clarify our approach to executive power, for both the purpose of pushing a future administration towards necessary structural changes, and also to use it as a weapon that illuminates the balking, compromising, and ultimately cowardly nature of the political alternatives. It is a flag of independent radicalism. 

It shows that the ability to restructure the United States in a more popular and socialist direction exists–and that only the radical socialists have the vision to do so.
